Question One
Read the following scenarios and answer the questions following.
(a) Mark purchased a set of outdoor chairs from a furniture shop. He paid €230 for six foldout chairs made from treated timber and
After only two weeks, Mark noticed that one of the chairs had a large crack running up one of its legs. Mark knew the chairs had been in perfect condition when he bought them, so he took the faulty chair back to the furniture shop to ask for a replacement.
When Mark returned to the shop with his proof of purchase, the attendant was reluctant to give him a replacement chair. Mark explained that he was happy with the chairs, and he just wanted to exchange the single faulty chair for a new one. The attendant refused, saying that he didn´t want to break up a new set of six just to give Mark one chair
(i) What, if anything, is Mark entitled to in this scenario? Support your answer with reference to relevant legislation.
(ii) What should Mark do next? Include reference to regulatory bodies (at least 2 Which Mark may need to; approach?
(b) Mrs. Murphy bought a dress for her daughter at a sale. The next day she found that her daughter had also gone to the sale and bought the same dress. Mrs. Murphy.
The store also refused to give her an exchange or store credit because the dress was a sale item.
Is Mrs. Murphy entitled to a refund, exchange or store credit? Support your answer with relevant legislation.
(C) You go into Electric City and buy yourself a game console. When you get it home you decide to pull it apart to see how it works. The problem is that when you put it back together, it no longer works. You hope the assistant in the shop takes a quick look, figures out what is wrong in a few minutes and repairs it for you with no charge.
(i) What do you think will happen when you return to the shop? Refer to relevant legislation in accordance with warranties in your answer.
